Baines Imaging Group (BIG) has secured a spoliation order compelling The Avenues Clinic, operated by Medical Investments Ltd, to restore its access to the radiology department following last week’s closure.

The ruling was issued after BIG filed an urgent application, arguing that it had been unlawfully removed from the premises it had occupied for more than 25 years.

The incident, which occurred during the Defence Forces holiday, saw BIG staff and management escorted out of the hospital, disrupting diagnostic services for patients.

In its court application, BIG stated that the removal had been based on a disputed arbitration award and carried out without the necessary court enforcement papers.

The High Court granted the order on Wednesday, directing The Avenues Clinic and its representatives to return BIG to “undisturbed and peaceful possession” of its leased premises, including the Diagnostic Imaging Department, CT Scan Suite and 3T MRI Suite.

The decision allows BIG to resume its operations at the hospital.

Relations between the two parties have reportedly been strained since 2023, when a new shareholder joined Medical Investments Ltd.

BIG alleges the shareholder showed interest in taking over the radiology business despite the company’s lease having been renewed until 2031.
