Alison Charles, whose brother Gavin Dean Charles died after being gunned down on August 1, has taken President Emmerson Mnangagwa to the High Court again. Charles has petitioned the High Court seeking an order barring the seven-member Commission of Inquiry from looking into the events of August 1 until the High Court rules on his earlier challenge. He has previously challenged the legality of the commission led by former South African President Kgalema Motlanthe which was appointed to look into the August 1 violence which resulted in the deaths of at least 7 people after soldiers used live bullets to quell a protest by opposition supporters. In his application which is yet to be ruled on, Charles argues that the Commission is compromised as some of the members are biased. Part of his latest urgent chamber application reads:
The legality of the first respondent’s (Mnangagwa) executive decision to appoint the commission of inquiry, the composition of such and its terms of reference have and are being challenged by the applicants before this honourable court under case number HC8436/18.
