The High Court sitting in Harare has granted a civil forfeiture order against former NetOne Cellular (Pvt) Ltd cashier Daniel Kalira and four others, following an opposed application brought by the Prosecutor General.
In a judgment handed down on Thursday, the High Court ruled that a luxury vehicle and an immovable property, identified as proceeds of unlawful activities, be forfeited to the State.
According to the National Prosecuting Authority (NPA), Kalira, the first respondent, is a former cashier at NetOne, a government-owned parastatal.
The second respondent, who appeared in person, was linked to property associated with the proceeds, while the remaining respondents were involved in the ownership and registration of the assets in question.
The court ordered the forfeiture of a Toyota Hilux Double Cab and an undivided 6.0283% share (Share Number 18) in Stand 913 Mandara Township, measuring 3.6134 hectares and held under Deed of Transfer 3518/2016.
The first three respondents were instructed to sign all documents necessary to transfer the forfeited assets to the State within seven days, failing which the Sheriff of Zimbabwe will execute the transfers on their behalf.
The fourth respondent was directed to facilitate the registration of ownership in favour of the State when called upon.
