High Court gives group go ahead to sue NERA for property loss/damages suffered during last year’s demo

The High Court has granted Citizens Against Violence and Anarchy Trust (CAVAAT), the go ahead to sue the National Electoral Reform Agenda (NERA), for property loss/damages suffered during last year’s August demonstration.

In November 2016 the group filed an application at the High Court to have the National Electoral Reform Agenda (NERA) held liable for the looting and destruction of property in Harare’s Central Business District during a demonstration held around August. CAVAAT intends to institute a class action on behalf of several affected business people who lost their property in the demonstration.

Although the loss is yet to be quantified, CAVAAT, led by former police assistant commissioner Faustino Mazango, resolved to sue NERA for damages in a bid to assist the affected victims recover their property. The application was filed at the High Court in terms of Section 3(1) of the Class Actions Act for leave to institute class action on behalf of the victims. In terms of that law, the class action cannot be instituted directly without seeking permission from the court.
