"No Evidence Suggesting Chivhayo Bribed Kazhanje" High Court

High Court Judge, Justice Amy Tsanga has granted the former Zimbabwe Power Company (ZPC) board chairman, Stanley Kazhanje a $1000 bail pending appeal saying that there was no evidence suggesting that he was bribed by Intratek Zimbabwe boss, Wicknell Chivayo.

Justice Tsanga said that there was no evidence suggesting that Kazhanje failed to disclose his past relations with Intratrek because he had an interest in the Gwanda Solar Project. Justice Tsanga ruled:

Strictly speaking, there was no evidence placed before the court a quo that he had a personal interest in the Gwanda solar project.

The prospects of success on conviction are, in my view, therefore, not manifestly doomed to failure. If there is a possibility of conviction being set aside, it stands to reason that so will sentence.

The development comes after Kazhanje was convicted and sentenced to an effective one-year jail term for allegedly concealing a US$10 000 payment from Chivayo.

The State alleges that the money was meant to influence Kazhanje’s decision as ZPC board chair on the Gwanda Solar Project tender in favour of Chivhayo who was eventually awarded the tender.
