The current structure of leadership of the government and army where Chiwenga, the country’s VP doubles up as the Minister of Defence is unconstitutional, said constitutional lawyer and academic, Alex Magaisa today.
In a thread of tweets, Magaisa said that there must be a clear separation between the military and civil leadership and that the military is subordinate to the civilian leadership.
2. There’s a good reason why the democratic order demarcates between military & civil space, requiring the military to stay in the barracks while civilians govern the civil space. This distinction & the need for the forces to remain apolitical is enshrined in our Constitution.

4. The aberration of November when the civil-military chain of command was broken must never be repeated. It was seen as necessary but it contaminated political space. It will take some time but it’s a collective duty to ensure the political space is clear of that contamination

6. Current situation where a Vice President doubles up as the Minister of Defence is patently unconstitutional. It disregards the Constitution which specifies that the President must appoint a Minister of Defence. Constitutionally, a VP cannot also be a substantive Minister.
