Suspended Gweru Mayor Hamutendi Kombayi’s was extended a lifeline after his application to have his case referred to the Constitutional Court was granted by Gweru Provincial Magistrate Pathekhile Msipa yesterday.
Kombayi (39) is facing charges of violating section 88 of the Postal and Telecommunications Act after he sent insulting messages to Local Government ministry permanent secretary George Mlilo. Kombayi is not disputing sending the messages but is arguing that the charges violate his freedom of expression.
Magistrate Msipa said in her ruling:
The application is, hereby, granted and referred to the Constitutional Court for determination
