Zengeza West legislator, Job Sikhala, has been denied bail again when he appeared before Harare magistrate Tafadzwa Miti.
The magistrate ruled that Sikhala is an incurable and unrepentant criminal, despite the fact that Sikhala has no conviction in over 60 arrests, <a href="https://www.newzimbabwe.com/sikhala-denied-bail-magistrate-labels-him-incorrigible-unrepentant-criminal/">New Zimbabwe</a> reported.
Sikhala is accused of inciting public violence to avenge the death of slain Citizens Coalition for Change (CCC) activist Moreblessing Ali.
In his latest bail application, Sikhala cited changed circumstances noting that his alleged accomplice, Godfrey Sithole was recently granted ZW$50 000 bail having spent 150 days in custody.
Sikhala was arrested in June and has to date spent 162 days at Chikurubi Maximum Prison, without trial.
14 other CCC activists who were arrested for allegedly reacting to Sikhala’s incitement were granted bail last week.
In denying him bail, the magistrate ruled Sikhala deserved jail because he was unrepentant having been arrested over the same offence 67 times before. Ruled magistrate Miti:

The accused was out on bail on a similar offence unlike his co-accused. A judicial officer cannot sit and determine an issue that has been dealt with by another.
 His arrest for more than 63 times on similar charges is proof enough that there is a propensity to commit similar offences.
The changed circumstances that his co-accused was released on bail will not apply as the number of times he has been arrested is proof that he is an incorrigible and unrepentant criminal.
The granting of bail will jeopardise the criminal justice system therefore the application for bail on changed circumstances is therefore dismissed.

 Sikhala previously claimed that the ruling ZANU PF, which is accused of capturing the judiciary, was planning on keeping him in prison until after the 2023 elections. He reckoned the ruling party is afraid of his influence.
His prolonged detention has attracted criticism from the international community including the United States and Britain.

Magistrate Says There Is A Possibility Sikhala Will Commit A Similar Offence If Granted Bail

Opposition Citizens Coalition for Change’s (CCC) Member of Parliament for Chitungwiza North, <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> has been granted bail.
His party made the announcement in a statement seen by Pindula News. Read the statement posted on the microblogging site, Twitter:

BREAKING: Hon Godfrey Sithole has finally been granted bail after spending 149 days in prison without trial. In a new Zimbabwe, a person is innocent until proven guilty not vice versa like what we’re currently experiencing under Mr Mnangagwa’s regime.

Sithole was arrested in June allegedly for inciting the 14 June public violence which erupted in Nyatsine during the funeral wake of slain CCC activist, <a href="https://www.pindula.co.zw/Moreblessing_Ali">Moreblessing Ali.</a>
He was arrested together with Zengeza West legislator, <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> who is still in jail.
There are more than a dozen other CCC activists who were also arrested over the violence.
Sithole was granted $300 000 bail by Harare regional magistrate Mrs Marehwanazvo Gofa.
He was also ordered to report twice a week at Chitungwiza Police Station and surrender his passport as part of his bail conditions.
Sithole was represented by lawyer Oliver Marwa, who made a fresh bail application on changed circumstances on Wednesday.
The legislator is expected back in court along with Sikhala on November 15 for trial.

CCC MP Godfrey Sithole Granted Bail 149 Days Later

Jailed Zengeza West legislator, <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a>, has released a statement to mark his 50th birthday saying he is strengthened by the fact that some prominent politicians also celebrated their birthdays in prison. In a statement seen by Pindula News, Sikhala who is detained at  <a href="https://www.pindula.co.zw/Chikurubi_Maximum_Security_Prison">Chikurubi Maximum Prison</a> said Zimbabwe is continuously degenerating into poverty because the old generation is clinging to medieval politics. Sikhala was arrested in June and charged with inciting public violence which erupted during the funeral wake of slain Citizens Coalition for Change (CCC) activist, <a href="https://www.pindula.co.zw/Moreblessing_Ali">Moreblessing Ali.</a> Through lawyer Freddy Masarirevu who is his family and personal spokesman, Sikhala said:

50 years ago, on the 30th of October 1972, in the village of Masema in Gutu, Sophia Mugari and Adrew Sikhala procreated Job. It is this great day which I am celebrating today under incarceration and trepidation in Chikurubi Maximum Security Prison. This has been made so not because I am a criminal. I am being denied my liberty together with my colleagues here and being persecuted for my deep beliefs and values in the freedom and happiness of our people. Human life is sacrosanct. Moreblessing Ali’s life was as treasury as everyone’s life. I am happy to suffer for that good. 
Today, my daughter, Monalisa, would have baked a special birthday cake for her dad. My wife Ellen would have made five more to share with the good people of Zengeza West, Chitungwiza in general, and hundreds of colleagues from all over Zimbabwe. Usually, it is a huge gathering event for me, my family, and friends. Evil plotters conspired to ruin my special day and this happy moment by their obsession with persecuting my person. Congratulations to them all for getting satisfaction from this facade of a charade. 
What gives me utmost happiness is that I am not the first and will not be the last political prisoner to celebrate their birthdays under persecution from an evil dictatorship. History is awash with such personalities. Nelson Mandela celebrated 27 consecutive birthdays in prison; <a href="https://www.pindula.co.zw/Dumiso_Dabengwa">Dumiso Dabengwa</a> 7,<a href="https://www.pindula.co.zw/Lookout_Masuku"> Lookout Masuku</a> 7, Bakili Muluzi 10, Raila Odinga 10, and many other good men and women of upright standing. 
Last month, I heard someone celebrated their 80th birthday —30 years older than me. I am the age of his 3rd born child. Persecuting a child for a difference in political views and beliefs is as preposterous as it comes.
Elders in our country have played a major role in liberating our beloved country. I have unquestionable respect for their profound role. However, the needs and demands of today call for new thinking and ideas which are in tandem with the modem 21st Century, to catch up with rapid changing times. There is need of urgent political and economic reforms in our country which the old generation is refusing to relent. Times change. Our Country is the odd one, not only in the region but in the whole world without a functioning industry. The only one with the Government as the largest employer, “salarying” its employees slave wages. 
This has been justified through a big lie. Countries which are frequently touted did not develop through archaic politics. There were extensive political and economic reforms in the Soviet Union and China to re-engineer their lives to move with the times. Mikhail Gorbachev was brave to bring perestroika and glasnost and dump Stalin and Brezhnev’s insanity. Deng Xiaoping dumped Mao’s cultural revolution and cult of personality politics and fostered both economic and political reforms to move with the changing times. Our great nation is daily drifting towards the stone age era. The cause is the old generation that is clinging to the Stalinist and Maoist traditions of medieval politics. We will not relent in calling for the release of our country from the jaws of the kleptocratic looting brigade of today. 
My wife had baked me a cake, but they refused to let her deliver it to me. I am not surprised. Today, I will toast water and share the love of the people of Zimbabwe with Hon. <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> and the rest of the inmates.

Birthday In Prison: Sikhala Says Nelson Mandela Celebrated 27 Years In Prison

Opposition Citizens Coalition for Change (CCC) leader, Nelson Chamisa has reported that prison authorities denied the wife and family of detained Job Sikhala from delivering a birthday cake to him.
The Zengeza West Member of Parliament who turns 50 years today has been in prison since June after he was arrested and charged with inciting public violence which erupted in Nyatsime during the funeral wake of slain CCC activist, Moreblessing Ali.
In a Twitter post seen by Pindula News, Chamisa described Sikhala, popularly known as Wiwa, as “the citizens’ hero.” He said:

Today Hon @JobSikhala1 turns 50. Sadly, I’ve just heard from his wife that they had baked a bday cake for him but Prison authorities denied the family the opportunity to have the cake delivered to him in prison. Join me in wishing the citizens’ hero a happy birthday. God bless Wiwa!

Sikhala and fellow legislator, Godfrey Sithole (Chitungwiza North) as well as 16 other Nyatsime residents have on several occasions <a href="https://zero.pindula.co.zw/job-sikhala-denied-bail-a-sixth-time/">been denied bail.</a> 
Sikhala, an <a href="https://www.pindula.co.zw/MDC_Alliance">MDC Alliance</a> MP, is accused of obstructing justice for allegedly recording a video threatening the murderers of CCC activist Moreblessing Ali.
He is also charged with inciting public violence under the same facts.

Prison Authorities Block Family From Delivering Birthday Cake To Detained Job Sikhala

The Permanent Secretary for Information, Publicity and Broadcasting Services, Nick Mangwana has said the Electoral Act of 2022 would bar individuals convicted of some offences including public violence from participating in elections.
He said in a Twitter post:

Individuals convicted of offences related to public violence, breach of trust and dishonesty at least a year before sitting of the nomination court would be ineligible to contest for public office under proposed amendments to the Electoral Act
</blockquote>
Mangwana’s remarks come after Cabinet Tuesday 04 October 2022 <a href="https://news.pindula.co.zw/2022/10/05/cabinet-approves-the-electoral-amendment-bill-2022-paving-way-for-creation-of-reserved-seats-for-youths/">approved the Electoral Amendment Bill 2022</a>, which seeks to amend the Electoral Act [Chapter 2:13] to provide for, among others: the timeframe within which National Assembly and Local Authority candidates can withdraw from contesting in an election; incorporation of the 30% women quota as well as the youth quota; and amendment of the definition of proof of identity. In terms of the constitution of Zimbabwe, one has to be a citizen in order to qualify as a voter.
Meanwhile, award-winning journalist, Hopewell Chin’ono, says the legislation is an indication that the ruling party is afraid of the opposition hence the plan to lock them up. He said:

Electoral Act: Individuals Convicted Of Public Violence May Not Contest In An Election

Pro-democracy campaigner, <a href="https://www.pindula.co.zw/Makomborero_Haruzivishe">Makomborero Haruzivishe</a> has said Zimbabwean jails have 60 political prisoners who are victims of the ruling ZANU PF’s capture of the judiciary.
In Twitter posts seen by Pindula News, Haruzivishe who himself has in the past been <a href="https://news.pindula.co.zw/2022/01/07/mdc-alliance-activist-makomborero-haruzivishe-granted-bail-2/">detained for a prolonged period of time</a> says the ruling party was weaponising the law. He said:

60 Zimbabweans are in jail not because they are criminals, they are imprisoned because they are political activists. They are in jail because ZanuPf weaponized the law against them. They are in bondage because of a captured justice system. 
</blockquote>
Haruzivishe who is a member of the opposition Citizens Coalition for Change (CCC) had earlier posted on the same platform demanding the release of them all and an end to judicial capture. Read his initial post:

The ruling ZANU PF party, however, denies allegations that it influences court decisions saying the judiciary is independent of the executive.

They were arrested in June over the 14 June Nyatsime violence which erupted during the funeral wake of slain CCC activist, Moreblessing Ali. They were accused of inciting public violence after they demanded justice for the murdered activist.

"Zimbabwean Jails Have 60 Political Prisoners" - Makomborero Haruzivishe

Detained opposition legislators, Job Sikhala and Godfrey Sithole have paid saluted fellow legislators, who were fighting for their release, <a href="https://www.newzimbabwe.com/jailed-sikhala-and-sithole-pay-homage-to-sympathisers-curiously-mum-on-chamisas-ccc-solidarity/">NewZimbabwe</a> reported.
Sikhala and Sithole together with 15 Nyatsime residents were arrested in June this year over the June 14 violence which erupted in Nyatsime during the funeral wake of slain Citizens Coalition for Change (CCC) activist, Moreblessing Ali. 
Their efforts to get bail have not yielded any positive results. In a statement, Sikhala and Sithole said:

The purpose of this statement is not to express regret, sadness, or disappointment, but rather to express gratitude for your support through various initiatives from the day of our arrest to the present.
On numerous occasions, we have heard the roars of our colleagues in Parliament, the Honourable Temba Mliswa and the Honourable Rusty Markham.
We appreciate your efforts, brothers, in demanding justice in our case. It is heartwarming to know that you understand and appreciate our inner pain and are actively doing something about it.
We can not hide the fact that we have suffered for the past four months. As humans, there is a certain amount of pain and suffering we can endure.
A lot has been happening during our incarceration, which we strongly feel is unjustified and most importantly unlawful, as it violates the fundamental pillars of constitutionalism and the rule of law.
</blockquote>
The two legislators’ failure to mention their party in the statement has, however, triggered debate in political corridors with some suggesting that it could be a sign of bad blood between the MPs and the leaders of the CCC.
The opposition party downplayed the issue, saying on Twitter;

Please note that they did so because they did a first statement last week which was focusing on thanking the party and party champions for the solidarity.
They do the statements now and then focusing on certain issues that the detained Champions see fit to address.

In their fifth failed attempt to secure bail, Ellen Shiriyedenga was the only influential CCC member appearing in solidarity with Sikhala and Sithole.
CCC leader, Nelson Chamisa was reportedly in Bikita attending the burial of a little-known member, while the MPs were appearing in court which attracted criticism from some of his followers.
While there are some who accuse the party of not doing enough to secure the release of its detained members, the CCC has maintained that it was strategising behind the scenes to get bail for the MPs.

Detained Sikhala, Sithole Salute Fellow MPs For Their Support

Opposition legislators <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> (Zengeza West) and <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> (Chitungwiza North) have abandoned their planned appeal against a magistrate’s ruling denying them bail for the fifth consecutive time.
The duo was earlier this week <a href="https://zero.pindula.co.zw/sikhaka-sithole-denied-bail-for-a-5th-consecutive-time/">denied bail for a 5th consecutive time</a> in a case they are accused of inciting public violence which erupted on June 14 in Nyatsime <a href="https://zero.pindula.co.zw/ccc-activist-moreblessing-ali-found-dead/">during the funeral wake of slain</a> Citizens Coalition for Change (CCC) activist <a href="https://www.pindula.co.zw/Moreblessing_Ali">Moreblessing Ali.</a>
They have now shifted attention to their earlier plea to be given State papers in order to prepare for their trial, <a href="https://www.newzimbabwe.com/sikhala-sithole-abandon-planned-appeal-state-refuses-to-give-them-case-papers/">NewZimbabwe</a> reported.
Sikhala and Sithole Tuesday appeared before Harare magistrate Dennis Mangosi and were remanded to October 20 for routine remand.
Their attorney Jeremiah Bamu told the court that his clients were no longer interested in appealing Tuesday’s ruling denying them bail. He said:

The accused have made a decision not to go further with the appeal of the case from yesterday but will be requesting for the copy of the ruling handed out yesterday and full case document.
</blockquote>
Bamu further indicated that although in terms of the law the State can give the defence papers two days before trial it was a short period to prepare.
Bamu told the court that he hoped the State would give him the papers and the video that is going to be used during the trial for his clients to have a fair trial.
The State has in the past promised to give them the papers but has not done so arguing that the video in question was still being analysed.
The State represented by prosecutor Lancelot Mutsokoti said they would give the defence papers but should they fail, it wouldn’t be a violation of the laws.

Sikhala, Sithole Ditch Plan To Appeal Against Ruling On Bail

Zengeza West Member of Parliament (MP), Job Sikhala was together with Chitungwiza North MP, Godfrey Sithole denied bail for the fifth consecutive time when they appeared before a Harare Magistrate this Wednesday.
 Sithole and Sikhala had applied for bail arguing that circumstances had changed.
Harare Magistrate Taurai Manuwere, however, denied them bail saying there are no changed circumstances to warrant the duo getting bail.
They are facing charges of inciting public violence which erupted in Nyatsime on 14 June during the funeral wake of slain Citizens Coalition for Change (CCC) activist, Moreblessing Ali.
They were arrested in June together with 14 other Nyatsime residents and have been in jail since then. 
Another Nyatsime resident was arrested last week over the same incident while other accused persons are said to be on the run.
The CCC party led by Nelson Chamisa, a former Minister of ICT, Postal and Courier Services during the Government of National Unity (GNU) says its members are political detainees.

Sikhaka, Sithole Denied Bail For A 5th Consecutive Time

A United Kingdom Member of Parliament, Lord Jonathan Oates Wednesday 28 September 2022 asked what the UK government was doing with regard to the prolonged detention of opposition MP <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a>.
Sikhala was arrested in June together with a fellow legislator, <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> and 14 Nyatsime residents over public violence which erupted in Nyatsime on 14 June during the funeral wake of slain Citizens Coalition for Change (CCC) activist Moreblessing Ali.
They have been in prison since then with courts <a href="https://news.pindula.co.zw/2022/08/31/zengeza-west-mp-job-sikhala-denied-bail-again-2/">denying them bail on several occasions.</a>
Responding to Oates’ question, the Minister of State in the Foreign, Commonwealth and Development Office Lord Goldsmith said his government was monitoring the detention of the political activists. Goldsmith said:

The former Minister for Africa met with the Foreign Minister of Zimbabwe on 30 June and reiterated the importance of all political parties respecting the rule of law, refraining from violence and respecting the right of others’ to campaign freely ahead of upcoming elections in 2023.
</blockquote>
The CCC party has often argued that its members were being detained for political reasons to force their party.
Law expert Professor Lovemore Madhuku said Sikhala and others <a href="https://news.pindula.co.zw/2022/09/06/madhuku-says-sikhala-sithole-nyatsime-activists-are-victims-of-their-parties-refusal-to-dialogue-with-ed/">were “victims of their party’s refusal to join the Political Actors Dialogue,”</a> a platform initiated by President Emmerson Mnangagwa for parties that participated in the 2018 elections to engage in dialogue.
Meanwhile, about 52 000 people have signed a petition calling for the release of Sikhala and his colleagues.
The State says it has almost completed investigations into their case and they should stand trial on 15 November.

UK Parliament Discusses Sikhala's Prolonged Detention

The opposition <a href="https://www.pindula.co.zw/Citizens%27_Coalition_for_Change">Citizens Coalition for Change</a>‘s Southend branch has claimed that Central Intelligence Organisation (CIO) operatives are following and intimidating the children of slain CCC activist <a href="https://www.pindula.co.zw/Moreblessing_Ali">Moreblessing Ali.</a>
In a post on Twitter this Thursday, the party said:

We are disturbed to hear slain #CCC activist #MoreblessingAli’s grieving children are being followed &amp; intimidated by @edmnangagwa’s Central Intelligence Organisation operatives. This is a despicable corrupt use of state resources. Is it not enough that you killed their mum?
</blockquote>
<h2>Some context:</h2>
Moreblessing Ali went missing on 24 May 2022 after she had been kidnapped by <a href="https://www.pindula.co.zw/Pius_Jamba">Pius Mukandi,</a> alias <a href="https://www.pindula.co.zw/Pius_Jamba">Jamba</a>, at Chibhanguza Shopping Centre in Nyatsime.
Her mutilated body was found in a disused well on 11 June. 
Jamba who is believed to be a ZANU PF member was arrested in Hurungwe five days after the discovery of Ali’s body at his mother’s plot.
Moreblessing’s body is yet to be buried with her family demanding that their lawyer, <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a>, be released first.
Sikhala, who was at the forefront in demanding justice for Moreblessing, was arrested alongside Chitungwiza North member of Parliament Godfrey Sithole and 14 other CCC activists over the violence which erupted during Moreblessing Ali’s funeral wake.

<a href="https://www.pindula.co.zw/Linda_Masarira">Linda Tsungirirai Masarira</a> who leads the opposition <a href="https://www.pindula.co.zw/Labour,_Economists_and_African_Democrats" title="Labour, Economists and African Democrats">Labour, Economists and African Democrats</a> (LEAD) party has called for the release of 16 Citizens Coalition for Change (CCC) members who were arrested in June over the 14 June 2022 violence which erupted in Nyatsime.
Among the arrested are Members of Parliament (MPs) <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> (Zengeza West) and <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> (Chitungwiza North).
They have been in prison since June with courts <a href="https://news.pindula.co.zw/2022/08/31/zengeza-west-mp-job-sikhala-denied-bail-again-2/">denying them bail on several occasions</a>. 
Reflecting on her past, Masarira said she was once arrested during the time of the late founding leader of Zimbabwe, <a href="https://www.pindula.co.zw/Robert_Mugabe">Robert Mugabe</a> and she reckons the system under which she suffered hasn’t changed despite the fact that it’s about five years since Mugabe’s departure.
Mugabe’s predecessor, President <a href="https://www.pindula.co.zw/Emmerson_Mnangagwa">Emmerson Mnangagwa</a>, is being accused of presiding over a system that violates human rights. Masarira said in a Twitter post seen by Pindula News:

6years ago I faced political persecution under Mugabes regime. Fast forward 2022 people are still being persecuted for differing political opinions &amp; being denied bail which is a fundamental human right. If murderers &amp; corrupt elements are being granted bail why not #Nyatsime16

Her remarks echo those of the opposition CCC which argues that its members are being arrested for political reasons.
Government critics argue that the arrests are meant to intimidate and destabilise the opposition ahead of the 2023 harmonised elections.
Sikhala is one of the most vocal senior leaders in CCC. 
While the CCC activists are being detained for a prolonged period of time, several political elites accused of stealing millions of dollars from the state are being released from jail and in some cases, their charges dropped, much to the annoyance of the opposition.

"Murderers And Corrupt Elements Are Being Granted Bail, Why Not Nyatsime 16" - Masarira

The Zimbabwe Republic Police Saturday 25 September 2022 arrested five members of the opposition <a href="https://www.pindula.co.zw/Citizens%27_Coalition_for_Change">Citizens Coalition for Change (CCC)</a> for conducting a meeting in <a href="https://www.pindula.co.zw/Bikita">Bikita</a>, the party claimed.
CCC, led by <a href="https://www.pindula.co.zw/Nelson_Chamisa">Nelson Chamisa</a>, a former Minister of ICT, Postal and Courier Services during the <a href="https://www.pindula.co.zw/Government_of_National_Unity">Government of National Unity (GNU</a>), posted on social media platforms on Monday:

The @PoliceZimbabwe in Bikita East on Saturday arrested our change champions for conducting a party meeting. The arrested members are; Zebron Gumireshe (36 yrs), Petros Honye (69yrs),Levy Vhundukai (42yrs), Rumbidzai Kusakara (33yrs) and Rosalia Svaruka (46yrs).

This report comes when the party is calling for the release of its Members of Parliament, <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> (Chitungwiza North) and <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> (Zengeza West) as well as 14 Nyatsime activists who were arrested in June over the 14 June 2022 violence which erupted at the funeral wake of slain CCC activist <a href="https://www.pindula.co.zw/Moreblessing_Ali">Moreblessing Ali.</a>
The opposition party claims that its members are being arrested on trumped-up charges adding that the arrests are political.

Five CCC Activists Arrested "For Conducting A Party Meeting"

Opposition <a href="https://www.pindula.co.zw/Citizens%27_Coalition_for_Change">Citizens Coalition for Change (CCC)</a> national spokesperson, <a href="https://www.pindula.co.zw/Fadzayi_Mahere">Fadzayi Mahere</a> has accused the ZANU PF government of weaponising the law to attack political opponents.
She speaks as dozens of CCC activists including Members of Parliament <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> (Zengeza West) and <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a> (Chitungwiza North) are in jail for “political reasons” according to their party.
They were arrested in June over the 14 June Nyatsime violence that erupted during the funeral wake of slain CCC activist <a href="https://www.pindula.co.zw/Moreblessing_Ali">Moreblessing Ali</a>.
In a Twitter post seen by Pindula News, advocate Mahere said the detentions were a sign that the ZANU PF government was “dying.” She said:

Say their names. Detention without trial has no place in a democratic society. Silencing opponents by throwing them in jail is the biggest sign of a dying regime. Stop weaponizing the law to attack political opponents.

Critics say the arrests are meant to silence the opposition.
Meanwhile, the ruling party has always denied the allegations saying the judiciary is independent.
A few weeks ago, constitutional expert and leader of the opposition<a href="https://www.pindula.co.zw/National_Constitutional_Assembly"> National Constitutional Assembly (NCA)</a>, Professor <a href="https://www.pindula.co.zw/Lovemore_Madhuku">Lovemore Madhuku</a>, claimed that Sikhala and colleagues were <a href="https://news.pindula.co.zw/2022/09/06/madhuku-says-sikhala-sithole-nyatsime-activists-are-victims-of-their-parties-refusal-to-dialogue-with-ed/">victims of their party’s refusal to dialogue with president Emmerson Mnangagwa.</a>
His remarks were viewed, by the CCC, as proof that Sikhala was a political prisoner. 
Information secretary, <a href="https://www.pindula.co.zw/Nick_Mangwana">Nick Mangwana</a>, however, said the <a href="https://zero.pindula.co.zw/information-secretary-mangwana-says-the-president-cant-go-into-conflict-with-courts/">president would not interfere with the courts.</a>

Mahere Says Govt Should "Stop Weaponizing The Law To Attack Political Opponents"

Jeremiah Bhamu, the lawyer of jailed Zengeza West Member of Parliament, <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> has accused the court of altering its order to disadvantage his clients.
Bhamu made the claim after magistrate Taurai Manuwere dismissed an application to have deputy prosecutor-general Michael Reza and prosecutor Lancelot Mutsokoti <a href="https://zero.pindula.co.zw/beatrice-mtetwa-calls-for-the-arrest-of-prosecutors-micheal-reza-and-lancelot-mutsokoti/">charged for contempt of court.</a>
<a href="https://newsday.co.zw/local-news/article/200000302/court-doctors-its-order-to-prejudice-sikhala-lawyer">NewsDay Zimbabwe</a> reports that the application was made by <a href="https://www.pindula.co.zw/Beatrice_Mtetwa">Beatrice Mtetwa</a> on behalf of Sikhala and his co-accused Godfrey Sithole.
Mtetwa and Bhamu, who are taking instructions from the Zimbabwe Human Rights NGO Forum and Zimbabwe Lawyers for Human Rights, wanted Reza and Mutsokoti charged for defying an order to furnish the defence with State papers on the case.
The order was made by magistrate Feresi Chakanyuka on August 18.
Sikhala and Sithole want the State papers to allow them to prepare for the trial that has been set for November 21. Bhamu said the court could have doctored its papers to prejudice his clients. Bhamu said:

The written order with no timelines was erroneously written as it is different from what the court said that day.
An examination of the electronic record which captures what happened, if properly examined, states that the State was supposed to provide the papers at the end of day on August 18.
.. Mutsokoti (…) admitted that he was aware of the directive directing the furnishing of State papers by close of business on August 18. He confirmed that that was actually what the court ordered.

Friday, Bhamu said the court should order Mutsokoti to provide him with the papers on September 12.
Manuwere said he will rule on Bhamu’s application for the court to set new timelines. The magistrate said he wanted to find out if the court had the powers to do so.

Sikhala’s Lawyer Accuses The Court Of Altering Its Order To Disadvantage The Jailed MP

A Harare deputy chief magistrate Gibson Mandaza has denied bail to <a href="https://www.pindula.co.zw/Citizens%27_Coalition_for_Change">Citizens Coalition for Change (CCC)</a> Members of Parliament (MPs), <a href="https://www.pindula.co.zw/Job_Sikhala">Job Sikhala</a> and <a href="https://www.pindula.co.zw/Godfrey_Sithole">Godfrey Sithole</a>.
 He remanded the duo in custody to July 6. Their lawyers will launch an urgent appeal at the High Court
Magistrate Mandaza said Sikhala and Sithole are “a threat to public security” and likely to re-offend if released on bail. 
Mandaza ruled that Sikhala had already disregarded a High Court order that barred him from using Social Media. 
The duo was arrested last week on allegations of inciting public violence. This was after the eruption of violence during the funeral wake of slain CCC activist, Moreblessing Ali, which involved CCC and ZANU PF supporters. 
Responding to the development, CCC spokesperson<a href="https://www.pindula.co.zw/Fadzayi_Mahere"> Fadzayi Mahere</a> said Zimbabwe needs new leaders for it to be transformed into a society that promotes and values human freedoms. She said:

The more I see injustice, the more I’m fortified in the need to ensure we win Zimbabwe for change. Freedom, fairness, opportunity and personal security. Job and Godfrey are innocent. It’s not a crime to demand justice for an abducted, murdered citizen. We need new leaders.

<a href="https://www.pindula.co.zw/Pedzisai_Ruhanya">Pedzisai Ruhanya</a>, academic, journalist and political commentator said should just approach the courts with already prepared High Court appeals “on these political matters because the decisions are predictable.”
