Prophetic, Healing and Deliverance (PHD) Ministries founder Walter Magaya is scheduled to appear before the High Court accused of raping his congregant three times, causing her to have an abortion and obstructing the course of justice. Initially Magaya was only charged with rape.
Magaya is scheduled to appear before the High Court on April 3. Magaya was granted leave to approach the Constitutional Court in December 2016 by Harare Magistrate Vongai Muchuchuti to challenge his indictment for trial after the complainant in the matter withdrew the matter. Muchuchuti had ruled that the State had no evidence that Magaya had interfered with the complainant and coerced her to withdraw the matter. However his Constitutional Court application was thrown out in September 2017 citing some irregularities in his application.
The PHD Ministries founder’s lawyer unsuccessfully argued that there was no need for his client to be tried since the complainant had voluntarily withdrawn the matter but the State wanted the case to continue on the basis that the PHD cleric had coerced the complainant. The State argued that it had an affidavit in its possession where the complainant claimed she was threatened into withdrawing the matter by some people whom she declined to name.
