Hellen Chivinge has taken Harare City Council to the Harare Civil Court where she is claiming $6 700 damages after she fell into a trench while walking along Grosvenor Road in Highlands and broke her ankle. She is accusing council of negligence after workers left an unsecured trench. Magistrate Brighton Pabwe deferred the matter to a later date.
The court heard that Chivinge fell into a trench on July 31, 2015. The trench had been dug by council for Internet cable laying and there were no markings or signs on the road or anywhere near the drain to give notice to road users of its existence. Chivinge claims to have lost earnings in the sum of $1 100 incurred medical expenses amounting to $600. She is claiming $5 000 as general damages for pain and suffering against the council.
