Through his lawyer Mr David Hofisi, Acie Lumumba (real name William Mutumanje), refused to reinstate his application at the Constitutional Court challenging the constitutionality of Section 32 subsection ( 2) b of the Criminal Law Codification and Reform Act chapter 9:23 which deals with the charge of undermining the authority of the president.
Lumumba withdrew his constitutional application when the National Prosecuting Authority (NPA) advised the Constitutional Court that it was withdrawing charges. However the State renegaded on the promise and yesterday, Prosecutor Mr Oscar Madhume told the court that the State is not withdrawing charges but is waiting for a prosecuting authority for the Acting Prosecutor-General to proceed to trial. Magistrate Ms Nomsa Sabarauta remanded the matter to July 28 for ruling.
