Controversial businessman Wicknell Chivayo who is being sued by Sunday Mail Features and Opinions Editor Garikai Mazara has argued that he does not understand the parts of the lawsuit that are in Shona. Mazara is suing Chivayo for $500 000 after the latter allegedly insulted him over Whatsapp for writing an article which was highly critical of Chivayo and exposed his lack of progress on the Gwanda solar project titled “The $202 million Gwanda Scam” in the Sunday Mail which came out on 19 February 2017.
Chivayo’s team of high-powered lawyers which includes advocates Nelson Chamisa, Thabani Mpofu, Silvester Hashiti and Regina Mabwe argue that Chivayo is unable to understand part of Mazara’s claim as it is written in Shona and other languages. Paragraph 4 of the claim contains words Shona words that were allegedly sent by Chivayo. The lawyers are demanding translation and definition of the terms. Chivayo wants the paragraph with the Shona words struck out and his lawyers have filed an application of exception to the claim.
Part of the application for exception reads:
The claim is consequently founded upon words that are meaningless, which have no legal consequence and which do not prima facie show any impairment of plaintiff’s dignity,
