Cricketer Fined $30 000 For Causing Death Of Former Tennis Player

A Harare magistrate has convicted Zimbabwean batsman, Tarisai Kenneth Musakanda, of culpable homicide and fined him $30 000.

Musakanda (27) was involved in a car accident that resulted in the death of a former tennis player, Gwinyai Chingoka early this year.

In her ruling, Harare magistrate Evelyn Mushavakure said the accident was a result of negligence on the part of the accused.

She said the accused failed to take a proper look-out while driving since it was dark and raining, while the now deceased was wearing dark colours.

Mushavakure said imprisonment would be too harsh since the accused is already suffering from trauma, knowing that he caused the death of someone. She said:

Therefore a fine of $30 000 would be proper.

Prosecuting, Takudzwa Jambawo alleged that Musakanda failed to exercise caution on the road, which resulted in him hitting Chingoka while he was crossing Simon Vengai Muzenda Road.

Chingoka allegedly sustained fractures on the left leg and elbow due to the impact.

Musakanda stopped at the scene of the accident and rushed Chingoka to Parirenyatwa Hospital for treatment.

The now-deceased was later transferred to West End hospital where he died in January 2022 this year.

Musakanda was represented by Nelson Tonhodzai from Musendekwa-Mtisi Legal Practitioners.
