High Court Orders Borrowdale Residents To Allow Wadyajena Access To His Property

The High Court has ordered the Borrowdale Brooke Home Owners Association to immediately restore legislator Justice Mayor Wadyajena‘s access rights to the Estate by reactivating his vehicles’ tags.

The High Court also ruled that Borrowdale Brooke Estate Home Owners Association should never deactivate Wadyajena’s access tags without a court order.

The Borrowdale Brooke Home Owners Association had barred Wadyajena from accessing his property accusing him of noise pollution. 

They said the Gokwe-Nembudziya MP (ZANU PF) spent more than three hours making noise with his sports car in the affluent suburb.

Borrowdale Brooke Golf Estate Chairman, Shingi Munyeza wrote a letter of disapproval to Wadyajena after residents were reportedly woken up with terrified pets whining because of the noise.

The court ruled:

1 The Respondent shall immediately restore Applicant’s access rights to the Borrowdale Brooke Estate by fully reactivating Applicant’s access tags.

2 The Respondent and its employees are hereby interdicted from deactivating Applicant’s access tags without following due process or the authority of a court order.

3 Each party shall brat its own costs.

Wadyajena denied the allegations that he has been making noise and disturbing his neighbours in Borrowdale suggesting they would have reported him to the Zimbabwe Republic Police (ZRP).
