Payment Of Licence Fees In US$ Outlawed

The payment of vehicle licence fees in United States Dollars (US$) has been outlawed after Mfundo Mlilo challenged the impounding of his vehicle without a warrant of a court order.

The court ruled that authorities had violated the provisions of the Finance Act by charging the vehicles’ registration and licence fees in US$. Reads part of the order:

IT IS ORDERED THAT:

  1. The 1st respondent’s actions, on the 21″ of September 2020, in impounding the applicant’s Sul motor vehicle, without warrant of court order, were unlawful, null and void.
  2. Part 1 relating to items 1 to 4 being fees that are expressed in United States Dollars, of the Vehicle Registration and Licensing (Amendment Regulations 2020) (No 21), published as Statutory Instrument 166 of 2020 be and is hereby declared ultra vires the provisions of the Finance Act Chapter 23:04 be and is hereby set aside.
  3. The respondent pays the costs of suit.
