CAG Tours Bus Sued US$407K For Death Of Harare Man

A Harare woman has dragged CAG Tours bus company to court demanding US$407 000 for the death of her husband who died last year due to the bus driver’s negligence.

The widow, Wona Macingwane wants the damages for her upkeep as well as that of her daughter Ayana Aneni Macingwane Chidzanira and father-in-law Webster Chidzanira.

The driver, Mamwena Tinashe Marombo, was convicted of culpable homicide and sentenced to two years’ imprisonment.

Court papers show that Marombo failed to give way at the intersection of Sam Nujoma and Josiah Chinamano on October 8, 2020, and rammed into a Toyota Hilux single cab vehicle driven by Macingwane’s husband, Tadiwanashe Chidzanira, killing him instantly.

Macingwane says she was forced to seek legal recourse after the bus company refused to entertain her compensation request. Her summons filed at the High Court read:

The premature termination of her husband’s life has necessitated a claim for basic necessities such as food, transport, and shelter until she remarries.

She endured trauma, pain, and suffering for the loss of life of her husband through Marombo’s negligence. She was not working as she was to complete her degree and solely relied on the deceased to take care of her and pay her tuition.

Macingwane is claiming:

  • US$50, 000 for the loss of her husband and family breadwinner
  • US$41, 200 for loss of love and emotional support.
  • US$218,000 for her daughter for emotional pain for the loss of a father and guardian.
  • US$168,000 for the daughter’s upkeep, with a US$1,000 monthly payout until she can support herself.
  • US$87,000 in damages for losing his son who was responsible for his upkeep and medical expenses.
  • US$2,095 for the casket,
  • US$800 for the purchase of a grave at Glen Forest,
  • US$9,600 in air travel for 6 families, among others costs.
  • US$14,000 for damage to her husband’s vehicle and
  • US1,000 for his cellphones that were crushed in the accident.

Macingwane’s husband was employed at Trade Kings Zimbabwe (Private) Limited as a quality controller.

The matter is yet to be heard.
