Veteran Challenges Eviction From Kasukuwere's Farm

Efanos Mudzimunnyi, a fighter in the liberation struggle has approached the High Court challenging an order which wants him evicted from Corncorpia farm which is owned by exiled former cabinet minister Saviour Kasukuwere.

He argued that the eviction would leave him homeless when he was issued with a valid offer letter for the farm. Kasukuwere last year challenged the “invasion” of his farm by war veterans who were allegedly harvesting his oranges and he was granted the order to evict them.

Mudzimunyi claims that Kasukuwere and his company Seaflower Investments had instructed the Sheriff to remove the war veteran from the farm. He said:

Court papers demonstrate there are now two competing judgments in respect of the same property. Annexure A demonstrates that there is a pending matter in respect of the same property between the first and second (Kasukuwere and Seaflower) and the third respondent (Lands Minister). As such it is imperative that execution be stayed and ejectment be stopped as the judgment in case HC1701/29 may be rendered a brutum fulmen if this is not sat down.

The applicant will be left homeless and with no recourse at law as it is also accepted that the first respondent (Kasukuwere) is now a fugitive from justice.

Mazowe District War Vets leader Efanos Mudzimunyi, Kudakwashe Moyana, Kenneth Mudzimunyi and Akim Mudzimunyi invaded the farm following permission by the late Minister of Agriculture minister Perrance Shiri.

The invasion and other activities on the farm reportedly affected the quality of fruits at the farm and also resulted in vandalism of property as Kasukuwere’s workers tried to stop them from encamping at the farm.
