The Judgement Did Not Expire - MDC T Responds To Claims That Khupe Ceased To Be The President Of The Court Resurrected MDC T

Thokozani Khupe’s spokesperson Khalipani Phugeni has dismissed Jameson Timba’s remarks that Khupe has ceased to the MDC T 2014 structures leader since she could not meet the deadline given by the court to hold an extraordinary congress, Newsday reports.

While responding to questions from Newsday about the MDC T  2014 structures term of office expiring, Phugeni said there is no such thing and there was no urgent chamber application dismissed:

There is no such thing. No urgent application was dismissed and Dr Khupe is the acting president by operation of the constitution and the Supreme Court acknowledged that. The judgment did not expire, what didn’t happen is only the extra-ordinary congress.

Everything else about that judgment is still in place. It didn’t expire, maybe until somebody goes to court and seeks a declaratory order to that effect, it did not expire. The extra-ordinary congress that did not happen, we are before the court now requesting for a variation of that judgment.

However, MDC Alliance has said the judgement expired and the court dismissed MDC T’s urgent application but agreed the matter will be heard before 3 judges soon. Komichi and Mwonzora have not yet commented on the issue
