Supreme Court Reverses Wicknell Chivhayo’s Fraud Acquittal

The National Prosecuting Authority(NPA) yesterday won its appeal to prosecute Intertrack MD Wicknell Chivayo on charges of fraud involving a Gwanda Solar Panel deal worth US$5.6 Million after the Supreme Court reversed his acquittal by the High Court, The Herald reports.

The NPA appealed Justice Owen Tagu’s ruling that had said the botched million dollar deal was more of a civil case and not a criminal one.

However yesterday a panel of 3 Judges, Justice Elizabeth Gwaunza, Justice Rita Makarau and Justice Susan Mavangira reversed the High court’s ruling and allowed the appeal.

Wicknell’s trial will now process according to the publication:

Writing the judgment for the three, Justice Makarau said the High Court erred in interfering with the unterminated criminal proceedings before the trial magistrate Mr Lazini Ncube and ruled that the fraud trial could now proceed.

  1. Justice should just prevail under all circumstances. There has to be difference between fraudsters and non fraudsters… Defenceless communities only find protection from the courts and equally from the army and the police and secret services in the event they are not compromised or manipulated by an obdurate few, greedy and power hungry.
