Suspended NetOne CEO Lazarus Muchenje won a case against the MNOs’ Board that suspended him on the banner that he was incompetent and refused to provide documentation for an audit, The Herald reports.
Muchenje who was suing the Mobile Network Operator and 4 board members had argued that the special resolution that had suspended him was patently unlawful and a nullity.
In her ruling, the presiding judge according to the publication cited that:
The resolution to suspend him was made by an improperly constituted meeting.
NetOne, however, challenged Justice Chirawu-Mugomba’s ruling and said the case was brought before the wrong court, the judge said the high court had jurisdiction to rule over constitutional matters.
