High Court Blocks Magistrates’ Court From Prosecuting Gumbura On Prison Break Charges

The High Court has stopped the prosecution of the jailed Robert Gumbura and other six people on the prison break charges.

High Court Judge Justice Tawanda Chitapi told the Magistrates’ Court that the prosecution has to wait until it rules on their review application for discharge.

Gumbura and his co-accused contested the dismissal of their application for discharge by Harare magistrate Francis Mapfumo at the close of State’s last year. They said that they were protesting over food and never attempted to break out of prison.

Mapfumo ruled that there was reasonable suspicion that the accused committed the offence and should be put to their defence.

Gumbura who is the leader of the RMG End Time Message, together with other six inmates, is being accused of attempting to break out of prison in 2013.

Meanwhile, two of the inmates who were also being accused together with Gumbura were acquitted at the close of the State’s case and Mapfumo said the remaining seven should explain why they went on prison rooftops if they were protesting over food on the day in question.
