Labour Court Orders Doctors To End Strike & Report For Duty

The Labour Court of Zimbabwe has ruled that members of the Zimbabwe Hospital Doctors’ Association (ZHDA) who have been on strike since September 3, 2019, should return to work forthwith as their strike is illegal. In its ruling the Labour Court said:

1. The collective job action engaged by members of the respondent on 3 September 2019 be and is hereby declared unlawful.

2. The said collective job action be and is hereby ordered to be terminated forthwith.

3. Members of respondents who participated in the said job action be and are hereby ordered to report for duty within forty-eight (48) hours from the date of this Order and the applicant shall be entitled to take disciplinary action against members of the respondent who fail or neglect to comply with this order.

4. The applicant shall not take any disciplinary action against members of the respondents who participated in the collective job action from 3 September 2019 up to the date of this Order.

5. The dispute between the applicant and members of the respondent be and is hereby referred to arbitration to be dealt with in terms of the Arbitration Act (Chapter 7:15). To this end:

(a) The arbitration shall be held within fourteen (14) days from the date of the Order.
(b) Parties are to agree to the requisite Terms of Reference,
(c) Applicant shall bear the costs of arbitration.

6. Each party to meet its own costs.

Doctors have been on strike demanding a salary hike after rejecting a 60 per cent increment offered by the government.

The revised salary offer would have seen the lowest-paid doctor taking home less than $2 500 per month.

Meanwhile, the government has increased salaries for regional magistrates to $9 500 per month with effect from 1 August 2019.
