Electoral Court Confirms Zanu-PF’s Nduna As Chegutu West MP Despite Zec Admitting Counting Error

 

The Electoral Court has confirmed Zanu-PF candidate Dexter Nduna as the winner of the Chegutu West parliamentary elections and dismissed the challenge lodged by Gift Konjana of the MDC Alliance. On August 2, the Zimbabwe Electoral Commission admitted that there were counting errors in the process and confirmed that Konjana had actually won the election. A letter written to Konjana by Zec said,

The data capturers explained that the results of Konjana Gift Machoka (MDC Alliance) and Kache Simon (UCADGZ) were interchanged. That is, instead of capturing Kache’s results as one (1) and Konjana’s as one hundred and twenty-one (121) they were reversed giving Kache (121) and Konjana (1).

…If the error is corrected Konjana Gift’s result would be ten thousand nine hundred and forty-eight (10948) votes against Nduna Dexter’s (ZANU-PF) ten thousand nine hundred and thirty-two (10 932). This makes Konjana Gift (MDC Alliance) the winner instead of Nduna.

However, High Court judge Justice Mary Zimba Dube dismissed Konjana’s application on a technicality saying that it was defective and did not comply with Rule 21 of the rules governing election petitions. The judge said the application failed to meet the strict procedural rules so she was forced to throw it out without reading the merits of the application. Konjana was ordered to pay the costs of the case.
