Biti’s Party Loses “Pro-Mnangagwa” Presidential Ballot Paper Court Challenge

The Tendai Biti led People’s Democratic Party (PDP) lost its bid to compel the Zimbabwe Electoral Commission (Zec) to change the design of the presidential ballot paper.

High Court judge Justice David Mangota dismissed PDP’s application on Thursday this week, saying PDP’s application lacked merit. Biti wanted an order declaring the current ballot paper’s design as inconsistent with the Constitution of Zimbabwe, the Electoral Act and the principal electoral regulations. PDP also sought an order to have the presidential ballot paper redesigned and have the names are listed in alphabetical order.

However, Justice Mangota dismissed the application with costs saying Zec had acted within the confines of the law. Mangota went on to commend the change in administration that took place last November saying it had opened up the democratic space. Said Justice Mangota:

The applicant (PDP) failed to establish a prima facie case. It hinged its argument on the form as opposed to the substance of the ballot paper. Its case stands on nothing. It is completely devoid of merit. It is, in the premise, dismissed with costs.
