Chinese Duo Who Shot Zanu-PF MP’s Son After Mistaken Identity Seek Discharge, Say Evidence Is Weak

 

Chinese nationals Luo Tin Gpen, Li Yize have applied for discharge arguing that the state has failed to prove the elements essential for attempted murder. The duo together with and their alleged accomplice, Gamuchirai Nigel Zuze shot Zanu-PF MP Keith Guzah’s son Kevin Guzah and his girlfriend Kudzanai Nduku in a case of mistaken identity, thinking that the two were responsible for an earlier robbery.

In their application, Gpen and Yize argue,

Firstly the first accused is alleged to have shot Kudzai. It has been shown that the State has failed to adduce sufficient evidence to show that there is a prima facie case against him in respect of the first count. The accused person has not been properly identified as being the individual involved in the shooting. A shooting occurred but that is insufficient to cause the conviction of the accused persons…The State and police could have but did not produce the bullets which were fired at the complainants.

The state is yet to respond.
