Deputy Chief Justice Elizabeth Gwaunza sitting with eight other judges of the Constitutional Court quashed a High Court ruling allowing companies and individuals to attach State property. The ruling was made High Court judge Justice Edith Mushore in a case in which Mutare businessman Tendai Blessing Mangwiro was seeking to recover $1.5 million which had been illegally seized by the police, who then failed to return the money.
The Constitutional Court ruled that Section 5(2) of the State Liabilities Act was lawful and in sync with the Constitution of Zimbabwe. Mangwiro was represented by Advocate Eric Matinenga while the state was represented by Advocate Thabani Mpofu.
