Court Turns Down Man’s Demand For $3 800 Monthly Maintenance, He Did Not Finish Paying Lobola

Bulawayo magistrate Sheunesu Matova has dismissed Wilson Sezi’s demand for $3 800 monthly maintenance from Zimbabwe International Trade Fair (ZITF) Company board chairperson, Ruth Ncube. Magistrate Matova dismissed the application for lack of merit saying that Sezi (53) who is unemployed had failed to prove that he was customarily married to the ZITF boss. Ncube had challenged the application saying Sezi was not her customary husband but a former boyfriend because he did not finish paying lobola.

In passing judgement, Magistrate Sezi said,

…there is no way this court can find that a customary union existed between the parties when the respondent’s family insists that applicant (Sezi) had not complied with essential Ndebele customs for him to be recognised as husband to the respondent (Ncube).

For the reasons stated above, the court upholds the preliminary point taken by the applicant that no customary union exists between the parties. In the result, it is hereby ordered that the applicant’s claim for spousal maintenance be and is hereby dismissed with no orders as to costs.
