High Court judge Justice David Mangota ruled that Minister of Environment, Water and Climate Oppah Muchinguri-Kashiri acted unlawfully when she issued the Zimbabwe National Water Authority (Raw Water Tariffs) Statutory Instrument 48 of 2016 hiking raw water charges for commercial agriculture from $9,45 to $12 per mega litre.
This comes after Hippo Valley Estates and Triangle Limited approached the High Court arguing that Muchinguri-Kashiri hiked the charges in spite of agreements entered by the commercial farmers and Zimbabwe National Water Authority (Zinwa). Under the agreement, the commercial farmers and Zinwa should discuss and agree on the raw water tariff with the minister allowed to intervene when the parties reach a deadlock.
Mangota said Muchinguri-Kashiri acted unlawfully arguing that she has no power at all to review water tariffs in the first agreement.
