Magamba Cultural Activist Network Trust (Magamba Network)’s bid to recover computers that were seized by police on November 8 this year as part of investigations hit a brick wall after High Court judge Justice Happias Zhou ruled that police actions were lawful.
Magamba Network had filed an urgent chamber application through their lawyer Mr Tonderai Bhatasara of Mapanga, Bhatasara Legal Practitioners arguing that the warrant of search and seizure relied on was too wide and general, and is therefore invalid. In his ruling, Justice Zhou said that the warrant is not general but specifically identifies laptops, computers and printers as the items to which it relates. He dismissed the application with costs.
The computers were seized following the arrest of an American national Martha O’Donovan who was arrested on and charged with attempting to subvert a constitutional government.
