High Court judge Justice Priscilla Chigumba has granted an interdict order stopping the Judicial Services Commission (JSC) from instituting any processes to replace Advocate Ray Goba as the Prosecutor-General. Justice Chigumba who heard the urgent application in her chambers ruled that until the matter is finalised, Ray Goba will remain appointed as the Prosecutor-General.
This follows an urgent application from the Zimbabwe Lawyers for Human Rights (ZLHR) who filed an urgent application seeking to prevent President Mugabe and the JSC from removing or in any other way interfering with Advocate Goba’s constitutional appointment. Advocate Eric Matinenga argued the matter on behalf of the ZLHR.
The ZLHR is arguing that the Prosecutor General cannot be removed from office without the President following the procedures laid out in the Constitution and this includes setting up a tribunal to investigate the Prosecutor-General first.
This comes after government cancelled the appointment of Advocate Ray Goba’s appointment as Prosecutor General. Goba’s appointment was repealed in October after he had replaced Johannes Tomana as prosecutor general in September. The lawyers filed the application after the JSC had reopened nominations to choose a suitable candidate to assume the position of Prosecutor-General.
The application was filed before President Robert Mugabe had resigned.
