Mnangagwa files $3 million lawsuit after Moyo refuses to apologise

Vice President Emmerson Mnangagwa has filed a $3 million defamation lawsuit after High Education Minister Professor Jonathan Moyo refused to apologise for statements that the vice president forced broadcaster Godfrey Majonga to jump out of flat.

Mnangagwa had given Moyo 7 days to retract the claims. Moyo has been given 10 days to respond to Mnangagwa’s court application, failure of which a default judgement will be passed. Below is Mnangagwa’s High Court application filed on September 29:

Plaintiff’s claim against Defendant is for general damages for defamation of character commensurate of the gravity and extent of the case pursuant to a video authored, presented circulated by Defendant to the members of the ZANU PF Politburo and the general public on or about 19 July 2017 concerning Plaintiff which was per se defamatory Plaintiff claims damages in the following amounts –

a) Payment of the sum of USS3,000 000.00 (three million 0,350 States dollars, and
b) Interest thereon at the rate of 5% per annum reckoned from the date of judgment to the date of payment in full. and c) Costs of suit on the party and party scale If you wish to oppose any of the Plaintiffs claims you must –

a) Enter an appearance to defend by making an aPOroPhate entrY In the appearance book kept in the office of the Registration of the High Court of Zimbabwe at Harare within ten days (10) after service of this summons (Saturdays. Sundays and Public Holidays are not counted as part of this ten-day period. nor is the day on which this summons was served). and
b) Notify the Plaintiff or his Legal Practitioner, in writing. at the address given below. of your entry of appearance to defend You must give the Plaintiff or the Legal Practitioners an address for service within five kilometers of the court specified above, together with a postal address
If you do not enter an appearance to defend. the Plaintiff’s claims will be heard and dealt with by the High Court without further notice to you
The Sheriff of his lawful deputy is hereby required to serve a copy of this summons on the Defendant named above and immediately after doing so. to return a further copy of the summons. with a return of Service in Form No 5 A duly completed to the Registrar who issued it .
