High Court orders police officers to return property they seized unlawfully and orders them to pay costs

High Court judge Justice Happias Zhou has ordered Zimbabwe Republic Police (ZRP) officers to return property which they seized from Harare businessman Tawanda Major two months ago. The cops took Major’s property and arrested him on fraud allegations after failing to locate his ex-wife who allegedly borrowed money from a senior police officer under false pretences. The police then took Major’s property without a court order. Major has since filed a $600 000 against the police for unlawful arrest and detention as well as defamation.

In his ruling Justice Zhou said:

It is ordered that the third, fourth, fifth and sixth respondents (police officers) jointly or severally be and is hereby ordered to return forthwith applicant’s personal and private property being 65inch curve Samsung television set, a 42 inch Samsung television set, a set of black leather sofas, two beds, one microwave, one table, one radio set, Mercedes Benz E320 and a vehicle registration book for a Range Rover together with its agreement of sale.

The third, fourth, fifth and sixth respondents shall bear costs of this suit,
