Victim’s daughter appeals against sentence after magistrate gives offender community service for culpable homicide

Farai Maruva has appealed at the Gweru Magistrate’s Court against the sentence that was given to Letwin Garatiya saying that it was too lenient. Garatiya assaulted Maruva’s father with a log after his cattle had strayed into her garden. Maruva’s father later died due to the injuries sustained. However, Gweru regional magistrate Morgan Nemadire sentenced Garatiya to a five-year jail term which was suspended on condition that she performs 525 hours of community service.

This did not go down well with Maruva who appealed against the sentence saying:

Our client is seeking your assistance to appeal the sentence handed by regional magistrate Morgan Nemadire in the above mentioned case (State vs Letwin Garatiya CR 38/08/16.

We are further advised that the offence was committed in aggravating circumstances which suffice to justify incarceration at the expense of community service. Our client was not satisfied with the decision of the court.

The matter has not been set down yet for gearing at the High Court.
