Harare High Court judge Justice Helena Charewa has ordered ZESA Holdings to pay $15 000 in damages to Mrs Constance Sinachinga, a Harare resident. MMrsSinachinga sued the company after her 8-year old son Takudzwa Nyandoro was electrocuted on 29 March 2012, after Zesa employees had left electrified wires exposed in an area frequented by the public in Eastlea, Harare. The Zesa employees had failed to place warning signs or to cordon off the area to warn and protect members of the public. Mrs. Sinachinga, who was represented by Bellinda Chinowawa of Zimbabwe Lawyers for Human Rights, initially sued for $500 000 although she later reduced her ask to $15 000 after being advised to do my the court. Zetdc denied being liable for Takudzwa’s death but Justice Charewa found the power company to be liable due to their gross gegligence and ordered Zesa to pay $15 000 in damages.
