ConCourt to determine the lawfulness of Jonathan Moyo’s arrest for corruption today

The full bench of the Constitutional Court will today determine the lawfulness of Jonathan Moyo’s arrest for swindling money from the Zimbabwe Manpower Development Fund (Zimdef).

In his main application, Moyo questions the constitutional validity of his arrest by Zacc and the role played by the police, arguing that the Constitution does not give ZACC the power to arrest and detain suspects. He also argues that the Prosecutor General does not have the power to order the police to arrest an individual. Moyo is seeking to stop his appearance in court, describing it as illegal.

However, acting PG Advocate Ray Goba denied directing the police to arrest Minister Moyo, but insists he directed the Police Commissioner-General to follow due process of the law and assist in the finalisation of investigations by the Zimbabwe Anti-Corruption Commission.
