Acie Lumumba to return to Con Court after State reneges on withdrawing charges in F-you Mugabe case

Former Zanu PF member turned opposition activist William Gerald Mutumanje, who goes by Acie Lumumba has notified the Magistrates’ court that he will be filing another application for referral to the Constitutional Court. This comes after the state prosecutors reneged on withdrawing charges against him, after notifying the Constitutional Court that it was doing so. Because of that Lumumba dropped his Constitutional Court application in which he was challenging the constitutionality of the law criminalising insulting the president.  Lumumba is facing charges after he allegedly said “F*ck you President Mugabe” last year.

Lumumba told magistrate Nomsa Sabarauta:

The ConCourt proceedings are being transcribed and will be certified by the judge before they can be presented to this court. We seek the case’s postponement pending compilation of the transcript.

I also put the State on notice that an application for referral of the matter to ConCourt based on fair trial rights as enshrined in section 69 of the constitution will be made.

It is important because fair trial rights are not subject to limitation.

The matter was deferred to July 24.
