Leader of the opposition party Viva Zimbabwe and former Zanu-PF youth leader William Mutumanje, who goes by Acie Lumumba has withdrawn his application at the Constitutional Court. Lumumba was challenging the constitutionality of Section 32 subsection ( 2) b of the Criminal Law Codification and Reform Act chapter 9:23 which deals with the charge of undermining the authority of the president.
Before the matter could be heard, the state developed cold feet and indicated that they were dropping all charges against Lumumba at the Magistrate’s Court. Chief Justice Luke Malaba ruled that by consent the matter should be removed from the roll for the reason that it had been withdrawn. The court did not make an order on as to cost.
Lumumba was facing charges of undermining the authority of the president after he insulted President Mugabe using the f-word.
