Magistrates Court stops Linda Masarira from performing community service pending High Court hearing

On Friday 5 May 2017, Mbare Magistrate Stanford Mambanje granted an application filed by Linda Masarira for the suspension of community service pending the hearing of an appeal in the High Court against her conviction and sentence for participating in the July 2016 stay away.

Earlier this year, Masarira was convicted by Magistrate Mambanje and sentenced to serve 385 hours of community service at Marlborough clinic in Harare. Masarira was also sentenced to serve 18 months imprisonment, with 7 months being suspended for 5 years on condition of good behaviour while 11 months were suspended on condition she performs 385 hours of community service. However, Masarira’s lawyers Obey Shava and Kudzayi Kadzere of Zimbabwe Lawyers for Human Rights filed High Court application against both conviction and sentence. Justice Edith Mushore granted the request, paving way for Masarira to challenge Magistrate Mambanje’s ruling.
