High Court makes landmark ruling on lobola & inheritance

Harare High Court judge Justice Happias Zhou ruled that a couple that stays together for a long time as husband and wife without any payment of lobola does not upgrade the relationship to a legitimate marriage for the purposes of inheritance.

Justice Zhou said this while stripping the surviving spouse status off Ms Easter Dzwowa in the estate of the late Zimbabwe Electoral Commission (ZEC) chief elections officer Lovemore Sekeramayi after evidence of lobola payment was not produced before Master of High Court or a magistrate who had dealt with the case. Ms Dzwowa was staying with Sekeramayi at the time of his death at his Chisipite home. However, Sekeramayi’s legitimate wife Faith and her children challenged Dzwowa who was recognised by the Master of High Court as the surviving spouse. The court also reversed the decision of allocating Dzwowa the Chisipite house.

  1. Children born out of wed lock must not inherit anything, coz some women varikuzviita kuda kubatirira hupfumi hwemkadzi nemurume n yet vanenge vakashanda vari vaviri. It’s unfair to share property nevanhu vakaita semasmall Hse.
