Lawyer appears in court for selling non-existent stands using firm’s trust account

Russel Dzete a Bulawayo lawyer and 4 accomplices appeared in court for fraudulently selling stands to three people. The victims were defrauded of $38 600 and R60 000. Bulawayo Magistrate Tinashe Tashaya remanded the five to the 10th of April and granted them $300 bail each.
According to the state in one of the cases, in December 2015, Dzete and his accomplices claimed to be the owners of Mr Felix Moyo’s stand which is in Selbourne Park and advertised it in a local newspaper saying they were selling it. Mrs Gumbo agreed to pay $13 000 for the stand

On December 23, 2015, the complainant proceeded to Dzete`s office and met the trio and an agreement of sale was drafted after the complainant deposited $4 000 into Marondedze Mukuku and Partners’ CBZ trust account.

On the following day, Dzete ordered the law firm clerk to withdraw the money that was deposited by the complainant,

On December 31, 2015 the complainant proceeded with R60 000 to Dzete’s office. Dzete took the money and gave the complainant a receipt as proof of payment.

Mrs Gumbo got suspicious after reading in a local newspaper that the trio had duped other people by selling them the stand which did not belong to them.
