Anacleta Tshuma (30) of Burnside Bulawayo left people in the gallery shocked after she refused to go for paternity tests of her two children. This is is despite the fact that Tshuma had approached the court seeking maintenance from Davy Ndlovu (52) for the upkeep of the two children aged seven and five. She even asked the magistrate if he would assist her in the event that the children turned out not to be Ndlovu’s.
Tshuma said:
Are you going to assist me to look for the father of the children if he discovers that he is not the father? Is he going to change my children`s surname because they are using his surname. Who will take care of the children then?
Your Worship, l left this man in 2010 because he was not supporting our children. I need the money to buy food, clothes, medication and pay school fees for our children.
Ndlovu told the court that he was sterile and had medical evidence to support his assertions. He added that he had kept that fact away from Tshuma. He insisted he knew that the children were not his and only continued supporting them because he loved Tshuma.
These are not my children. I was failing to impregnate a woman and then in 2008 when l was 43-years-old l went to Thailand to seek medical attention. The doctors told me that I’m infertile. I got married to this woman but l didn’t tell her my condition. l kept it secret.
Ndlovu offered $150 in maintenance although he promised to sue Tshuma if the children turned out not to be his. Ho0wever, Tshuma managed to sneak away without signing the papers authorising the paternity test.
