Zimbabwe People First Elder Didymus Mutasa filed an urgent chamber application challenging the attachment of his property.Through his lawyers, Mutasa filed a stay of execution as well as an application for rescission of judgement at the High Court.
Rescission of judgment is when the High court cancels the earlier judgment, in this case the judgement which allowed the attachment of his property. However, the applications were made when the Sheriff of the High Court had already towed away his vehicles and household property over a debt of $ 26 900 owed to his former lawyers.
Mutasa is challenging the amount claimed by the lawyers saying it was unreasonable and was not calculated in terms of the Law Society of Zimbabwe. Mutasa also claimed that he was never served with the order compelling him to pay the debt.
The two applications are yet to be dealt with.
