Suspended Prosecutor General, Johannes Tomana who is facing six counts of criminal abuse of office, is challenging the constitutional validity of his prosecution at the High Court. Tomana’s lawyers will today make oral submissions at the court.
Tomana is arguing that the trial has not been brought within a reasonable period of time as most of the charges against him date back to 2009. He also states that memory has been affected by the passage of time and he argues that the decision by the Acting PG to charge him amounted to a breach of the Constitution. Tomana also argues that the criminal trial and the tribunal cannot run concurrently so the court must wait for the finalisation of the tribunal.
