Professor Jonathan Moyo‘s application at the Constitutional Court was ruled to be against’s the court’s rules. However, the Court did not throw it out. Instead it, postponed the hearing indefinitely in order to allow Moyo to comply with the court’s rules. Moyo is challenging his arrest by the Zimbabwe Anti-Corruption Commission, (ZACC) arguing that ZACC does not have the power to arrest anyone. ZACC accused Moyo of misusing funds belong to Zimdef
Moyo’s application was ruled to be defective after his lawyers failed to paginate all the pages against the court’s rules. The lawyers also breached another rule when they failed to bind the application. Moyo was ordered to pay the wasted costs.
Deputy Chief Justice Malaba said:
By consent, the application is postponed sine die (indefinitely) and the applicant to pay wasted costs in respect of the fourth respondent
