The country’s apex court, the Constitutional Court has dismissed an application challenging President Mugabe’s fitness to rule the country. The application was made by Tajamuka/Sesjikile member Promise Mkwananzi. Mkwananzi had cited Mugabe’s advanced age as well as his alleged willful violation of the country’s constitution among some of the reasons for making the application. The Court dismissed his challenge because the wrong procedure had been used in filing the papers. The case was dismissed by consent without costs.
Deputy Chief Justice Luke Malaba in his ruling said:
The application is dismissed on the basis that the respondent (Mugabe) was wrongly served with court papers. Instead of the papers being served at his Munhumutapa offices, the papers were served at the New Government Complex and they were served out of time as required by law.
Mkwananzi said he has full confidence in the country’s justice system despite this setback. He plans to make another application after 30 days.
We are going to make a fresh application before the court and ensure that the sheriff serves them in time to avoid such technicalities,
…The general retirement age is 65 but here we are talking of someone who will be 93 in a fee days who wants to remain in power at that age; that’s unacceptable and we will use a multi-pronged approach to get the old man out of power,
