Pastor Evan Mawarire's warned and cautioned statement taken at CID Law and Order

Activist and leader of ThisFlag Movement  Pastor Evan Mawarire was arrested yesterday after he returned home from exile in the United States and charged with Subversion.

Here is his warned and cautioned statement hat he gave to the police.

I, Evan Mawarire NR 63-982396-G-12 residing at house number 19 Monmouth Close, Avondale, Harare, having been informed by Detective Chief Inspector Runganga of CID Law and Order, Harare that enquiries are being made in connection with a case of Subverting Constitutional Government as defined in section 22(2)(3) of the Criminal Law (Codification and Reform), Act Chapter 9:23 , which occurred in Harare during the period extending from 13 July 2016 to December 2016 where it is alleged that I incited the Public to revolt against a constitutionally elected government by urging all Zimbabweans from all walks of life either locally or internationally to revolt and overthrow the government of Zimbabwe.

It is also alleged that I circulated several videos on social media platforms in which I incited Zimbabweans to stage violent demonstrations to subvert the constitutional government of Zimbabwe, and resultantly from August 2016 to January 2017 there have been violent demonstrations in the country where several property was destroy.

It is further alleged that after the violence and on 15 September 2016 through social media, I incited Zimbabweans in America and all over the world to converge in New York on 22 September 2016 to confront the President of Zimbabwe who was attending a United Nations seminar and order him to immediately resign from his position accusing him of destroying the country, make this statement of my own free will. While I have been warned that I am not obliged to say anything in answer to these allegations, my failure at this stage to mention any facts relevant to my defence to them may result in a court drawing inferences against me. Whatever I say will be put in writing and may be given in court as evidence.

You are also advised that you are entitled to the following rights:-

• To appear before a court within 48 hours unless further detention has been authorized by a competent court.

• Not to be forced to make a confession.

• The reason for detention.

• To approach the High Court for an order of Habeas Corpus i.e an order requiring you to be released, or to be brought before the court for the lawfulness of the detention to be justified.

• To be considered innocent until proven guilty.

• To be informed promptly of the charge in sufficient detail to enable you tO answer it.
