Criminal Insult charges against Wadyajena withdrawn after Undenge’s wife dropped charges

Gokwe-Nembudziya MP Justice Mayor Wadyajena is a freeman after the state withdrew charges of criminal insult against him.  The complainant,  Letina Munamato Undenge, is Energy and Power Development Minister Samuel Undenge’s wife.  The charges were withdrawn after she filed an affidavit s dropping the charges.

The prosecutor Takunda Ndovorwi told the court:

The State wishes to withdraw charges before plea as the complainant has filed a withdrawal affidavit. The State will stick to that since the accused had not been formally charged.

However, the defence opposed the withdrawing of the charges before plea saying that they wanted the charges to be withdrawn after plea.  That way, the prosecutors would not be able to charge Wadyejena at a later date.

The accused feels prejudiced by attending this court so many times after the state elected to charge him. This is clearly in violation of his right and he feels he should have been afforded time to clear his name. It is proper that if the State is to withdraw charges, the withdrawal has to be after plea since the accused has already filed his defence outline

Victoria Falls resident magistrate Ms. Lindiwe Maphosa accepted the withdrawal before plea, saying the defence outline made no difference.

Wadyejena allegedly said unprintable words to Letina Undenge in December 2015  during Zanu-PF’s 15th Annual People’s Conference in Victoria Falls.
