Magaya accuses Prosecutor General of harassing him by pursuing rape case

Prophetic Healing and Deliverance Ministries leader, Walter Magaya, has accused the acting Prosecutor General, Ray Goba, of harassment after his office indicated it wanted the prophet formally charged at the High Court for allegedly raping a congregant who has since withdrawn the charges claiming to have fabricated them against the cleric.

However, Chief Law Officer Mr Michael Mugabe told the magistrate court the prosecution intended to indict Magaya for trial at the High Court despite the woman’s affidavit. Advocate Thabani Mpofu, who is representing Magaya with instructions from Rubaya and Chatambudza Legal Practitioners, challenged the State’s intention to indict but his objection was overruled by magistrate Mr Vakayi Chikwekwe who gave the State the go ahead to formally charge Magaya.

Magaya’s lawyer gave notice for an application for referral of the matter to the Constitutional Court and raised constitutional issues which they said could only be dealt with by the apex court. In his affidavit in support of the written application filed today, Magaya claimed he was a victim of fabricated rape charges and said the State’s intention to proceed with the matter was an abuse of judicial process.
