Bulawayo High Court Judges deliver conflicting judgements on same case

Last week, two Bulawayo High Court Judges delivered conflicting judgements on a similar case in which Ms Gamila Atwa Ibrahim Youssef El Zont an Egyptian national has been engaged in a series of legal disputes against a lawyer and a curator over unpaid legal and curator fees amounting to almost $200 000.

Justice Martin Makonese dismissed the curator, Ms Motsi’s application saying:

In my view, the Master of the High Court ought to have the curator’s fees properly taxed and that is the remedy the applicant is entitled to. The matter does not deserve to be treated on an urgent basis as this dispute over the curator fees has been ongoing since May 2016, and accordingly the application be and is hereby dismissed

On the other hand, Justice Lawrence Kamocha  interdicted Ms Youssef El Zont, the Master of the High Court and the Registrar of Deeds from continuing with the administration, winding up and distribution of the estate pending the finalisation of the matter.
