Fiona Mubango (31), a Zimbabwean caregiver who stole almost €10,000 from a 92-year-old man she was caring for has the lost the case to prevent her from being deported. Mubango failed to compensate the victim leading to the Minister of Justice signing a deportation order. Mubango successfully challenged the deportation order twice only to lose the latest attempt.
High Court Justice Richard Humphreys rejected her challenge to the deportation order due to the “repulsive nature of crime” and went on to say:
Having regard to the fact Mubango abused the hospitality of the State to offend against a vulnerable person, it did not appear necessary for the court to facilitate a judicial review of that withdrawal of hospitality.
It was not the case there was any infirmity in the Minister’s analysis of her right to private life entitlement and the Minister could still have lawfully concluded the factors favouring deportation outweighed any such right.
